These Official Rules constitute the full and complete Official Rules for the Eisenberg® National Hot Dog Month Tee Shirt Sweepstakes (“Sweepstakes”). The Sweepstakes is open only to legal residents of the 48 contiguous United States and District of Columbia who are 18 years of age or older or the age of majority in their state of residence (whichever is older) and who have a valid Instagram account at the time the applicable Promotion Period begins. Sweepstakes are void outside of the contiguous United States and where prohibited by law.

The Sweepstakes is open and offered only to legal residents of the 48 contiguous United States of America (“U.S.”) and the District of Columbia (“D.C.”), who are 18 years of age or older and have an Instagram account set to public at the time of entry. Your Instagram account must remain public until a winner is selected so that Sponsor can contact you if you are a potential winner. Residents of Alaska, Hawaii, Puerto Rico, and U.S. territories are not eligible to enter or win.

Employees, officers, and directors of Home Market Foods, Inc. (“Sponsor”), its parent, subsidiaries, affiliates, agencies, and prize suppliers, and their immediate families (parent, child, sibling, or spouse) and/or household members, and any other persons or entities associated with this Sweepstakes, are ineligible to enter or win.

Void outside of the 48 contiguous U.S. and D.C., and where prohibited or restricted by law.

By participating, those who enter the Sweepstakes (“Entrants”) agree to abide by and be bound by these Official Rules and the decisions of Sweepstakes Judges, which are final and binding in all matters relating to the Sweepstakes. Winning a Prize is contingent upon fulfilling all requirements set forth in these Official Rules.

The Sweepstakes begins when the first post describing how to enter the Sweepstakes is published on the Eisenberg® brand Instagram handle, @eisenbergfranks (the “Sweepstakes Post”) expected to be on or about July 1, 2026, and ends at 11:59:59 PM ET on July 24, 2026 (the “Promotion Period”). Sponsor’s database clock is the official time-keeping device for the Sweepstakes. Entries made outside of the Promotion Period will not be accepted.

You must have an active Instagram account, which is free to create, and your profile must be set to “public” in order to enter. To submit an entry (“Entry”), go to the Eisenberg® brand Instagram handle (@eisenbergfranks), locate and comment on the Sweepstakes Post during the Promotion Period, and do all three of the following:

  • (1) Follow @eisenbergfranks;
  • (2) Comment on the Sweepstakes Post (“Comment”); and
  • (3) In your Comment, tell us how you take your hot dog — loaded, classic, or extra mustard.

You must be following @eisenbergfranks for your Entry to be eligible to win. The Sweepstakes Post will include a call-to-action to comment.

ALTERNATIVE METHOD OF ENTRY: To receive one (1) Entry without using Instagram, mail a 3” x 5” index card with your full name, address, date of birth, phone number, and email address to: Eisenberg® Tee Shirt Sweepstakes, 39 McKinley St., Massapequa Park, NY 11762. Mail-in entries must be postmarked by July 24, 2026, and received by July 29, 2026. Mail-in entries have the same odds of winning as Instagram entries.

Entries will not be individually acknowledged. Limit one (1) Entry per person and per Instagram account during the Promotion Period. Multiple comments on the same Sweepstakes Post will not result in multiple Entries or increased chances of winning; only the first eligible Entry will be considered. Entries must comply with Instagram’s terms of use and may not contain any language or imagery which is lewd, obscene, hateful, defamatory, or otherwise inappropriate, as determined by Sponsor in its discretion, all of which are grounds for disqualification. Any attempt to enter more than one (1) time via multiple names, email addresses, Instagram accounts, or any other means, may result in disqualification from this and any other promotional offerings from Sponsor. Use of any macro, bot, script or other automated means to submit entries is prohibited. Proof of posting is not proof of accessibility of the posting to Sponsor or anyone else. Each entry will be deemed submitted by the authorized account holder of the email account associated with the Instagram account used to enter. An “authorized account holder” is defined as the natural person to whom the email address is assigned by an internet service provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the social media account used to enter.

By entering, each Entrant represents and warrants that his or her Entry:

  • (a) is original to him/her;
  • (b) does not violate any law, rule, regulation, or guideline;
  • (c) does not infringe upon or invade any right of any third party, including intellectual property rights, privacy, or other proprietary rights;
  • (d) is not defamatory, pornographic, or obscene, and does not contain nudity, explicit language, or offensive content as determined by Sponsor in its sole discretion;
  • (e) does not contain the image or personal information of any individual other than the Entrant; and
  • (f) does not contain commercial messages, advertising links, spam, or identifiable third-party trademarks or branding.

Entries received outside the Promotion Period are void. Sponsor may disqualify any Entrant at its sole discretion for failure to comply with these Official Rules. Your submission of an Entry constitutes your representation of eligibility and consent for Sponsor to obtain, use, and transfer your name, address, and other information for the purpose of Sweepstakes administration. By submitting an Entry, you warrant and represent that your Comment has been written by you as an original work and that all required third-party releases (if any) have been obtained in writing, and you further grant to Sponsor, and to its licensees, successors and assigns, and any person or entity acting on such entities’ behalf, the irrevocable right and non-exclusive license to copy, reproduce, edit, broadcast and otherwise use your Entry, including your Comment, in any way in any medium whether now existing or later discovered, worldwide, in perpetuity, including but not limited to posting such Entry online on Sponsor’s website and social media pages.

If the operation or administration of this Sweepstakes is impaired or incapable of running as planned for any reason, including but not limited to: (a) infection by computer virus or bugs; (b) tampering or unauthorized intervention; (c) fraud; (d) technical failures; or (e) any other cause that corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the Sweepstakes in whole or in part, and to disqualify any individual who tampers with the entry process. If the Sweepstakes is terminated before the designated end date, Sponsor will (if possible) select Winner(s) in a random drawing from all eligible, non-suspect entries unaffected by the problem. Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) TO THE FULLEST EXTENT PERMITTED BY LAW.

By participating in the Sweepstakes, Entrants agree to release and hold harmless Sponsor, Instagram, and each of their respective parents, employees, officers, directors, subsidiaries, affiliates, distributors, advertising and promotional agencies (collectively, the “Released Parties”) from and against any claim, liability, or cause of action arising out of participation in the Sweepstakes or receipt, use, or misuse of any Prize, including but not limited to: (a) any technical errors that may prevent an Entrant from submitting an Entry; (b) unauthorized human intervention in the Sweepstakes; (c) printing errors; (d) errors in the administration of the Sweepstakes or processing of Entries; or (e) injury or damage to persons or property caused, directly or indirectly, from Entrant’s participation in the Sweepstakes or receipt of any Prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering the Sweepstakes. Entrant waives the right to claim any damages whatsoever, including punitive, consequential, direct, or indirect damages.

Following the conclusion of the Promotion Period, on or about August 1, 2026, ten (10) potential Prize winners (each a “Winner”) will be randomly selected by Sponsor from among all eligible Entries submitted during the Promotion Period. Odds of winning depend on the number of eligible Entries received.

The potential Winners will be contacted via direct message to the Instagram account used to submit his/her Entry. No liability is assumed for any winner notification that is lost, intercepted or not received by a potential winner for any reason. If a potential Winner does not respond within three (3) days after the first contact attempt, or the Prize notification is returned as undeliverable, that potential Winner may be deemed to have forfeited the Prize and an alternate Winner may be selected. Judges’ decisions are final and binding in all matters relating to this Sweepstakes.

Except where prohibited by law, each potential Winner (or such potential Winner’s parent or legal guardian, if the potential Winner is a minor under the laws of his/her State of residence) will be required to complete and return an affidavit of eligibility and liability/publicity release within seven (7) days of receipt prior to being declared a Winner. If the potential Winner fails to comply with Sponsor’s requests for documentation within seven (7) days, is found to be ineligible, or cannot or does not comply with these Official Rules, the corresponding Entry may be disqualified, and an alternate potential Winner may be selected.

Ten (10) Prizes are available: each a limited-edition Eisenberg® branded t-shirt (a “Prize”), printed on demand in the size specified by the Winner via Instagram direct message following notification. T-shirts will be fulfilled within approximately four (4) to six (6) weeks after Sponsor’s receipt of Winner’s confirmed size and mailing address.

Approximate Retail Value (ARV) of each Prize: U.S. $35.00  |  Total ARV of all Prizes: U.S. $350.00

Limit one (1) Prize per person and per Instagram account. Only the Prizes described in these Official Rules will be awarded. Prizes are not redeemable for cash, are non-transferable, and no substitutions are offered, except at the sole discretion of the Sponsor. Sponsor reserves the right to substitute a Prize of equal or greater value at Sponsor’s discretion, including if the advertised Prize becomes unavailable.

If, for any reason, more bona fide winners come forward seeking to claim Prizes in excess of the number of Prizes set forth in these Official Rules, the winners, or remaining winners, as the case may be, of the advertised number of Prizes available may be selected in a random drawing from among all persons making purportedly valid claims for such Prize(s). Inclusion in such drawing shall be each entrant’s sole and exclusive remedy in such circumstances.

All federal, state, local, or other tax liabilities in connection with a Winner’s award, acceptance, or use of the Prize are the sole responsibility of the Winner.

By accepting a Prize, where permitted by law, the Winner grants to the Released Parties the right to print, publish, broadcast, and use worldwide in all media, without limitation, at any time, Winner’s full name, picture, voice, likeness, and/or biographical information for advertising, trade, and promotional purposes without further payment or additional consideration.

All information submitted by Entrants will be treated according to Sponsor’s privacy policy, available at https://www.homemarketfoods.com/wp-content/uploads/2025/06/Home_Market_Foods_Privacy_Policy_2023.pdf. By entering the Sweepstakes, Entrants hereby agree to Sponsor’s collection and usage of their personal information and acknowledge that they have read and accepted Sponsor’s Privacy Policy.

By entering the Sweepstakes, Entrants agree that: (a) any action at law or in equity arising out of or relating to the Sweepstakes or these Official Rules shall be filed in either the courts of the Commonwealth of Massachusetts or the U.S. District Court for the District of Massachusetts, and Entrant hereby consents to personal jurisdiction in such courts and expressly waives any right of change of venue or forum non conveniens, AND ANY RIGHT TO A TRIAL BY JURY IS HEREBY WAIVED; (b) any and all disputes shall be resolved individually, without resort to any form of class action; (c) any and all claims and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys’ fees; and (d) under no circumstances will any Entrant be permitted to obtain any award for, and Entrant hereby waives all rights to claim, punitive, incidental, or consequential damages.

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts without giving effect to any choice of law or conflict of law provisions.

For New Jersey Residents: Nothing herein prohibits recovery of damages or attorneys’ fees where required by statute.

To request the names, cities, and states of residence of the Winners, send a self-addressed, stamped business-size envelope within thirty (30) days after the end of the Promotion Period to: “Eisenberg® Tee Shirt Sweepstakes Winner List,” Home Market Foods, Inc., 400 First Avenue, Needham, MA 02494.
